The Day Before Dev Reportedly Sues Website for Calling Game a ‘Scam’

Fntastic, the developer behind The Day Before (we’ll be careful in our phrasing), one of 2023’s more disappointing video game releases, is reportedly suing a Russian media outlet for calling the game a “scam”, which it claims hurt the firm’s reputation. At this rate, we’re starting to doubt we’ll ever get that promised PS5 port.

Reported by 80 Level (thanks, PC Gamer), Fntastic is suing outlet Yakutia.info, which itself is running with the story. Apparently, both Fntastic and Yakutia.info originally hail from Yakutia, Russia, with the The Day Before studio, founded by the Gotovtsev brothers, having since relocated to Kazakhstan.

The suit seemingly hinges on a story that refers to Fntastic’s activities as a “scam”, and another in which the outlet allegedly paraphrased YouTube influencers who accused The Day Before of having “borrowed” mechanics from other games.

Yakutia.info says the word “scam” is “relatively new in the Russian language”, and changed the wording to “embarrassment” in the former once it was made aware of the studio’s suite, replacing the paraphrasing in the latter with direct quotes. The outlet claims that deleting the stories in question would infringe on its right to free speech, that it has been singled out amongst numerous other outlets, perhaps due to its small scale, but is willing to go to court over the matter.
