On August 29 in Napa, California, Chigvintsev was taken into custody under suspicion of domestic violence after an altercation with Garcia, which their 4-year-old son Matteo witnessed. On September 11th, Garcia initiated a divorce proceedings from Chigvintsev. In the paperwork, she stated their contentious encounter as the separation date and sought full legal and residential custody of Matteo.

On August 29th at 2:18 PM, the bail for the dance professional was paid and he was freed from detention, as verified by Wofford to TopMob News. At this point, a court date hasn’t been set.
In response to inquiries from NBC News, Wofford confirmed that Chigvintsev was taken into custody in Yountville, California. However, due to a request for privacy from the alleged victim, the exact location, identity, and age of the person involved were not disclosed. The Sheriff is also withholding this information.
According to an audio clip released by TMZ on August 30th, it was reported that Chigvintsev initially called 911 for medical assistance following a dispute in which shoes were supposedly thrown at him. However, the 42-year-old later informed the dispatcher that medical help was no longer necessary. Regardless of this, Wofford explained that authorities still conducted a wellness check.
