Baby Reindeer wrongly labelled a ‘true story’ by Netflix, judge rules

As a film enthusiast with a keen eye for authenticity and a deep appreciation for the power of storytelling, I find myself greatly troubled by this recent development concerning Netflix’s Baby Reindeer. While I understand the creative license that comes with crafting a compelling narrative, misrepresenting real-life individuals in such a manner can have devastating consequences.


A U.S. judge has decided that Netflix misrepresented their show “Baby Reindeer” by labeling it as a true story, and found no evidence that they verified the facts within the series creator Richard Gadd’s narrative or disguised Fiona Harvey as the basis for the character Martha.

The verdict grants Harvey the right to proceed with his defamation case against Netflix, as he is allegedly being stalked by Gadd.

In the drama series, Martha’s character wasn’t directly associated with Harvey, as portrayed by actress Jessica Gunning. However, the show started with a title stating, “This is based on real events.

Following the highly charged response to the show’s premiere, Harvey subsequently claimed that Baby Reindeer accused her of sexually assaulting Gadd, blindingly gouging his eyes, and serving a jail term for stalking him.

In her outfit, Harvey asserted that she’s never faced a criminal conviction and countered the streaming service’s allegations with charges of defamation, deliberate causing of emotional harm, negligence (both ordinary and gross), and infringements upon her right to personal privacy.

Judge Gary Klausner’s recent decision clearly states that there’s a significant distinction between the act of stalking and being found guilty of stalking by a court of law.

In a similar vein, it’s important to understand that there are significant distinctions between offensive behavior such as unwarranted touching and serious crimes like sexual assault. Similarly, there is a vast gap between acts like pushing someone and causing harm to another person’s eyes. Although the actions of the plaintiff are undeniably reprehensible, the statements made by the defendants are of an even greater severity and have the potential to evoke stronger negative reactions in an observer.

The judge chose to let the remainder of her lawsuit against Netflix proceed, but he rejected Harvey’s accusations of negligence and her demand for punitive damages.

In early 2021, Gadd provided a detailed statement to a federal court, explaining that he never meant for any character in the series to represent Martha Scott, specifically not Harvey. He further clarified that Martha Scott is distinct from Fiona Harvey, and just like all characters in the show, Martha is a made-up persona with characteristics unlike those of Harvey.

He went on: “Overall, it was an incredibly stressful and worrying time, with a sustained period of relentless behaviour taking place over several years.

Harvey’s behavior was extensive and varied, with numerous instances of uncomfortable personal encounters, attempts to engage, and disturbing forms of communication. It would be challenging, if not impossible, to cover every instance in detail.

A Netflix representative stated their intention to strongly contest the issue and uphold Richard Gadd’s freedom to share his account of events.

they claimed that Harvey had been imprisoned for being a twice-convicted stalker (with a five-year sentence) and accused him of sexually assaulting Gadd.

The defendants continued to tell untruths since they found it more appealing than reality, and more captivating tales brought in more profits.

The show gained immense popularity upon its launch earlier this year and has since emerged as a significant contender for awards, collecting a total of four Emmys – for Best Limited or Anthology Series, Best Writing for Richard Gadd, Best Actor for Gadd himself, and Best Supporting Actress for Jessica Gunning.
