Halle Berry Seeks Sole Legal Custody of Her and Olivier Martinez’s Son

Having followed Berry’s journey through her public custody battles in the past, it is heartening to see her prioritizing her son Maceo’s wellbeing and education.


Halle Berry is taking legal action. 

As a lifestyle expert looking back on events, I’d say: A year after my divorce with Olivier Martinez was finalized, and we agreed on shared physical and legal custody of our son Maceo, I have recently filed for sole legal custody of this wonderful 10-year-old boy, as reported by TopMob News based on the documents they’ve reviewed.

The filing was completed due to Martinez’s persistent disregard for Court Orders, as stated in the paperwork. In this document, Berry (who has been with songwriter Van Hunt since 2020) seeks sole custody or, if not possible, the final say in all decisions concerning their minor child’s education, mental health counseling, and therapy.

In the filing, Berry regards herself as “not perfect,” but has been “exemplary” when it comes to parenting, especially during conflict with Martinez. 

In the court documents, Berry claims that Martinez exploited her wish to maintain privacy regarding their disputes, following her high-profile custody battle with Gabriel Aubry over their daughter Nahla in the mid-2010s. Since then, they have been jointly parenting their child since 2014, with Berry paying $16,000 per month in child support.

As stated in Berry’s filing, Martinez’s actions have negatively affected not only Maceo, but also Maceo’s bond with his mother.

Moreover, the submitted documents allege that Martinez independently chose to “take a break during the summer” from co-parenting therapy. This decision allegedly slowed down the conclusion of individual sessions for both Berry and Martinez, thereby hindering the start of their joint sessions.

According to Berry’s petition, Martinez’s actions during the past few months, such as disregarding their shared parental counseling sessions, have forced her into seeking an adjustment in the joint legal custody agreement.

In addition, the 58-year-old refers to particular examples of delays in Martinez’s decisions about addressing their child’s educational requirements, as suggested by teachers, and the former husband’s failure to communicate about their son’s soccer schedules.

TopMob News has attempted to contact representatives of both Berry and Martinez concerning the filed document, however, we are still waiting for their response.

Berry’s filing comes nearly a year after the couple finalized their divorce, almost 10 years after their 2015 separation. In the original agreement, Berry and Martinez agreed to split legal and physical custody of their son. 

As a dedicated follower, I found myself obligated to shoulder the costs for the 10-year-old’s tuition, school uniforms, and supplies while he attends private school, as well as any extracurricular activities such as soccer, based on the documents reviewed by TopMob News at that time.

In addition to her role in the “John Wick” movie series, the actress was mandated to make monthly payments of $8,000 to Martinez. Furthermore, for every income she earns exceeding $2,000,000, she is required to pay 4.3% of that amount as well.

Before their custody arrangement, Berry had expressed that child support laws were considered outdated by her.

She expressed on Instagram in 2021 that some parents, regardless of gender, might require assistance. However, she also believes that in today’s progressive era, it is the duty of both men and women to provide financially for their children, strive diligently, and make every possible effort to fulfill this responsibility.
