Five years following the Empire actor’s accusation for falsely reporting a hate crime (resulting in a 150-day sentence in 2022, serving only six due to being convicted of five counts of disorderly conduct), the Illinois Supreme Court has reversed his criminal conviction.
In its verdict, the court stated, “Today, we clarify the State’s obligation to uphold agreements with defendants. We’ve decided that subjecting a defendant to a second trial in such cases constitutes a breach of due process. In the end, the state supreme court decided that Smollett should not have been indicted because he had a non-prosecution deal with the Cook County State Attorney’s Office. The court also mentioned that it was returning the case to the circuit court to officially declare the charges dropped.
The Supreme Court recognized in their ruling that the public attention surrounding the Smollett case was significant. They drew a comparison with a recent judgment from Pennsylvania, where they had previously considered the delicate equilibrium between ensuring public examination and preserving the rights of defendants.

He was mostly absent from viewers’ screens until 2024 when he appeared in the movie The Lost Holiday, co-starring with Vivica A. Fox.
Additionally, although he’s generally kept out of the limelight, Smollett has recently pondered over the series of events that unfolded, including the aftermath of his arrest.
He shared with People magazine in September that it was a particularly gloomy day for him, as it marked when he fully understood what was going on. He explained that many situations had challenged his resilience and mental fortitude, but one thing he never wavered on – he never questioned his identity and never felt like he wasn’t who he truly was.
