Following a lawsuit from Tempo Music Investments, who hold partial rights to Bruno Mars’ “When I Was Your Man,” claiming that Miley Cyrus and her co-writers plagiarized the track in their Grammy-winning song “Flowers”, Miley’s legal team has sought its dismissal.
In documents submitted on November 20th and obtained by TopMob News, Miley Cyrus’s legal team, along with co-writers Gregory Hein and Michael Pollack, Sony Music, and other associated companies connected to the song have contested the complaint filed by Tempo. They argue that the information provided in the initial filing is insufficient to determine the truth or falsity of the allegations, consequently denying all claims regarding copyright infringement.
In simpler terms, the argument continues by stating that Miley and her co-defendants do not need to provide a response because the initial accusations made by Tempo in their filing are merely legal opinions, and no response is typically needed for such opinions.
In light of insufficient proof, Miley’s legal team is asking the court to dismiss the case permanently. They also stated that the costs associated with the lawsuit would be covered by Tempo, and they seek additional remedies as the court sees fit.
Miley’s response comes two months after Tempo filed the lawsuit Sept. 16.
According to documents obtained by TopMob News, the original filing claims that Miley Cyrus’ ‘Flowers’ did not solely attain its success. It is said that ‘Flowers’ mirrors several musical aspects of Bruno Mars’ ‘When I Was Your Man’, such as similar melodic pitches and sequences, shared basslines, parts of the chorus, dramatic music elements, lyrical structures, and specific chord progressions.
The documents strongly suggest that Miley’s Best Pop Solo Performance Grammy award could not have been achieved without Bruno’s 2012 song, which was also nominated in the same category at the 2013 Grammys. Interestingly, it was “Royals” by Lorde that won instead.
Miley Cyrus’s song “Flowers” stayed at the peak of the Billboard charts for an impressive total of 106 weeks following its release in January 2023, spending eight of those weeks on the Hot 100. The track not only topped the charts but also brought her two Grammy awards – a significant achievement as these were her first ever wins after receiving just one nomination previously.
Additionally, it’s worth noting that “Flowers” marked her initial triumph with the Recording Academy, but before 2023, Miley had expressed her feelings of being overlooked by them.
