Files pertaining to Prince Harry‘s immigration to the United States may become public soon.
A federal judge has ordered the Department of Homeland Security to release the Duke of Sussex’s immigration records after conservative think tank The Heritage Foundation requested the documents under the Freedom of Information Act (FOIA).
Harry has been living in Southern California with his wife Meghan Markle and their kids—son Archie Harrison, 5, and Lilibet “Lili” Diana, 3—after stepping back from his duties as a senior royal in 2020.
“The request explained that Heritage was interested in learning whether the Duke ‘was properly vetted prior to or during admission into the United States’ in light of his admitted ‘continuous and substantial’ drug use,” U.S. District Judge Carl J. Nichols said in a signed order obtained by NBC News. “Heritage argued that a foreign national seeking to enter the United States must typically fill out forms that ask about past drug use.”
Nichols continued, “In Heritage’s view, the public has an interest in knowing which path was taken.”
The judge ultimately ruled in favor of The Heritage Foundation, saying that their argument for the release of a redacted version of Harry’s immigration docs “stands on firmer ground” than the one posed by the government’s defense lawyers, who have been fighting to keep the 40-year-old’s records private.
“Those redactions appearing appropriate,” Nichols wrote his order, “the government is ordered to lodge on the docket the redacted versions of those documents no later than March 18, 2025.”
TopMob News has reached out to Harry’s rep for comment but hasn’t heard back.
Harry has openly discussed his past drug use in detail. In the Spanish version of his memoir titled Spare, he confessed that he experimented with cocaine during his teenage years.
“Of course I had been taking cocaine at that time,” Harry wrote. “At someone’s house, during a hunting weekend, I was offered a line, and since then I had consumed some more.”
The royal—who is the youngest son of King Charles III and the late Princess Diana—contended that it “wasn’t very fun, and it didn’t make me feel especially happy as seemed to happen to others.”
He stated that experiencing something new and unique was his primary aim, as he recounted coping with the grief from his mother’s 1997 car accident. “I wanted to feel differently,” he emphasized, “to be distinct.
And while some members of the public have developed an interest in what Harry put down on his immigration forms pertaining to past drug use, President Donald Trump has said he has no interest in removing Harry from the country.
“I don’t want to do that,” Trump told the New York Post in February. “I’ll leave him alone.”

The Duke of Sussex reached a settlement with News Group Newspapers—which is responsible for The Sun as well as the now defunct News of the World—on Jan. 22 after suing the organization in 2019 over alleged unlawful actions on the part of journalists and private investigators working for the newspapers to obtain information on the royal family.
