
Sia is facing a new legal battle with Dan Bernad.
According to court documents obtained by TopMob News on October 28th, the estranged husband of singer Sia is seeking full custody of their 19-month-old son, Somersault “Summi” Wonder Bernad, as they go through their divorce.
Okay, so I’ve been following everything, and it’s just… heartbreaking. Apparently, Dan filed something claiming Sia is battling addiction issues, and he’s worried about their little one – the baby they had in March 2024. It’s awful, especially because they just announced they’re separating after only two years of marriage! I just feel so bad for the child, and honestly, I’m really worried about Sia too. It’s all just so sad.
In legal documents, Dan stated that Sia poses an immediate threat to their son. He claims she intentionally hid a two-week hospitalization in September, and tested positive for barbiturates and benzodiazepines without a valid medical reason.
Benzodiazepines, such as Xanax, Klonopin, and Valium, are common medications for anxiety and sleep problems. Barbiturates are another type of drug with similar uses, often prescribed for insomnia and to help prevent seizures, according to the Cleveland Clinic.
In addition to concerns about his ex-wife’s alleged drug use, Dan is seeking sole custody because he claims she broke their custody agreement by preventing him from seeing their child and improperly gave legal control over their child’s affairs to the nannies.
According to court documents, Dan argues that Sia’s actions are careless and put Summi in danger, showing a lack of concern for her safety and a disregard for legal orders. He claims Sia is struggling with substance abuse, making her unable to provide Summi with a safe and stable home environment, and therefore an unfit parent.
He also stated that, having previously worked as a radiation oncologist before marrying his ex-wife in 2022, he is the only parent who can provide a safe and stable environment for their son.

She also claimed she had been the main caregiver for Summi, and had primary custody, even before they began living apart.
Sia claims Dan is unemployed and prefers going to nightclubs and parties. She worries this behavior makes him an unfit parent, adding that it was a consistent issue during their short marriage.
She explained that when Dan visited Los Angeles, he only spent short amounts of time with Summi, and usually had nannies around.
TopMob News reached out to reps for Sia and Dan for comment but has not heard back.
