Emilie Kiser is seeking more privacy.
Following the disclosure that her husband, Brady Kiser, would not face charges regarding the death of their 3-year-old son Trigg Kiser, the TikToker submitted a petition for redaction of the initial police report suggesting indictment against him, as reported by People on July 31.
In a court filing, Emilie’s lawyers expressed their concern that if the report’s specifics are made public, they might be manipulated to produce distressing content related to her son’s unfortunate death due to an accidental drowning in the pool at their Arizona residence. Potential misuse could involve simulations using artificial intelligence, as suggested by the news outlet.
In the document it is stated, as reported by People, that attorney Matthew Kelly explained that the part of the report Ms. Kiser wants to conceal holds essential information and background needed for the public to have a fairly comprehensive grasp of the investigation into the drowning incident, the police department’s recommendation for criminal charges, and the county attorney’s decision not to prosecute criminally in this case.
On May 6, Trigg found himself at home with his father Brady and his younger brother Theodore (3 months old) when a tragic accident occurred. He accidentally drowned in their backyard swimming pool. Upon the arrival of emergency responders, they immediately transported the toddler to the hospital. Regrettably, he succumbed to his injuries six days later.
After investigating his death, the Chandler Police Department suggested a Class 4 felony charge of child abuse against Brady. According to reports from USA Today’s Arizona Republic affiliate, Brady stated that the drowning incident occurred when he momentarily lost sight of Trigg for approximately three to five minutes.
After delving deeper into the facts, I found myself questioning the outcome, but alas, my idol, the patriarch, wouldn’t face charges as the Maricopa County Attorney’s Office concluded there was insufficient evidence to secure a conviction. It’s a tough pill to swallow, but I trust in the justice system, even if it doesn’t always align with my fervent desires.
As a lifestyle expert, I’d rephrase it this way: “On July 25th, the Maricopa County Attorney’s Office shared details on their website. They revealed that a surveillance video outside the home provided insights into the tragic incident of drowning and the sequence of events that unfolded. To secure a conviction for this charge, the state must demonstrate to a unanimous jury, beyond any reasonable doubt, that the individual failed to recognize a significant and unnecessary risk. This oversight in recognizing the risk was an extreme departure from the level of care a prudent person would provide under similar circumstances.
After examining the evidence provided by the Chandler Police Department, it was concluded that this case does not reach the required level of proof.
Despite neither Brady nor Emilie publicly commenting on the unfortunate incident, Emilie took legal action in May by filing a lawsuit against various Maricopa County government entities with an aim to secure confidentiality for additional records related to Trigg’s demise.
“She lost her young son,” her attorney said in the suit, obtained by TopMob News at the time. “Emilie is trying her best to be there for her surviving son, 2-month-old Theodore. But every day is a battle.”
Emilie Kiser and Brady Kiser tied the knot in 2019.
The couple welcomed their first son, Trigg, in July 2021.
They became parents again in March 2025 with the arrival of their second son Theodore.
Emilie often documented life at home with her two boys on social media.
The family celebrated a happy Easter holiday together.
