Emilie Kiser’s Husband Brady Won’t Be Charged for Son’s Death

It has been announced that Emilie Kiser’s spouse will not have to deal with any legal disputes regarding the unfortunate demise of their child.

After the inquiry into the tragic death of the couple’s 3-year-old son, Trigg, officials disclosed their decision regarding whether Brady Kiser, who was looking after the toddler when he accidentally drowned in a pool at the family’s residence in Arizona, would face charges in connection with the incident.

Rachel Mitchell from the Maricopa County Attorney’s Office declared today that Brady Kiser will not face charges for the tragic drowning death of his son, as there is little chance of successfully prosecuting him. This information was shared on their official website on July 25th.

The attorney’s office admitted that initially, the Chandler Police Department suggested a Class 4 felony charge for child abuse against Brady in relation to Trigg’s death on May 12. However, they later found insufficient evidence to prove the alleged crime.

The surveillance footage outside the house revealed the sequence of events leading up to the drowning incident. To secure a conviction for this charge, the prosecution needs to demonstrate, without any doubt that could be reasonably questioned by a jury, that the individual failed to recognize an unjustifiably large risk and their failure to do so was significantly below the level of caution a prudent person would exercise.

In their assessment, every case presented to them for examination undergoes an evaluation based on whether there’s a strong possibility of a successful prosecution. The Maricopa County Attorney’s Office then stated that upon thorough examination of the evidence provided by Chandler PD, it was found that this particular case does not fulfill the required standard.

The statement added, “Given a court order, no additional details can be discussed at this time.”

Brady was at home with Trigg and his three-month-old son Theodore when he lost sight of Trigg for a few minutes. According to search warrants reviewed by USA Today’s Arizona Republic affiliate, this happened around three to five minutes. Trigg was found floating in the pool during this time. Emergency responders arrived, but sadly, the toddler was later taken to the hospital and passed away six days after the incident.

After Trigg’s demise, Emilie initiated a legal action, obtained by TopMob News, aimed at maintaining confidentiality of documents related to Trigg’s death against various Maricopa County public institutions.

And while the couple haven’t personally spoken out on the tragic incident, the content creator’s lawyer provided insight into how she’s been dealing with the tragedy, stating in the suit that she is “going through a parent’s worst nightmare right now.”

“She lost her young son,” the attorney continued. “Emilie is trying her best to be there for her surviving son, 2-month-old Theodore. But every day is a battle.”
