From my perspective, it seems like we’re witnessing a high-stakes game of cat and mouse between the tech mogul, the Pennsylvania district attorney, and the courts.
On November 4, a lawyer for both Elon Musk and the American Political Action Committee explained to a Pennsylvania judge that the individuals receiving their clients’ daily $1 million donations were specifically chosen due to their compelling personal narratives.
In his statement, Chris Gober, who is recognized as a lawyer often associated with U.S. Republicans, challenges the portrayal of the alleged “giveaways” as a form of voter lottery.
Voter incentive
In early October, Elon Musk unveiled a program with the promise that one randomly chosen, registered voter from Arizona, Georgia, Michigan, Nevada, North Carolina, Pennsylvania, or Wisconsin would receive $1 million each day until the election was held.
As reported by Forbes, Gober stated that the winners were not selected randomly, and no monetary prizes were awarded. This information comes from his conversation with Judge Angelo Foglietta.
“The $1 million recipients are not chosen by chance. We know exactly who will be announced as the $1 million recipient today and tomorrow.”
According to CNN Marshall Cohen reporting on X.com, the main issue in this case arises from comments made by Musk suggesting that participants in the program could win money at random, which has led people to label it a lottery or sweepstakes.
District Attorney Larry Krasner of Pennsylvania suggested that the actions taken by Elon Musk and America PAC were similar to operating an unlicensed game of chance, possibly leading to potential criminal accusations. As per a Forbes article, this is being contemplated by Krasner.
Criminal charges
Generally speaking, if you’re caught operating an illegal lottery within U.S. jurisdiction, you could face penalties such as losing your assets, paying fines, and spending up to a year in jail. However, an attempt to move the case to federal courts was rejected on November 1st, so it’s not guaranteed that federal laws will be enforced.
It’s uncertain if Elon Musk or members of the America Pac might be penalized with jail time for the alleged offenses. Preliminary investigation of Pennsylvania laws suggests that operating an unlawful lottery is considered a misdemeanor, and typically those convicted wouldn’t serve time in prison.
As a researcher, I’d like to clarify that contrary to some claims, there was no initial lottery. The selection process, as outlined in the report, involved choosing winners based on their compelling stories, who were then appointed as spokespersons. The $1 million awards were conditional upon fulfilling contractual obligations.
Although there’s still a chance that Musk and the America PAC might face federal charges (they’ve reportedly been warned by the U.S. Department of Justice), Musk’s connections with former U.S. President Donald Trump, who is currently running for office as a Republican, could potentially shield him if Trump wins the election.
If President Trump regains the White House in January, both he and Elon Musk have hinted that the tech entrepreneur may lend his expertise to the Department of Government Efficiency.
