In February 2025, Ms. Lively served a subpoena on Ms. Ferrer, who was represented by Mr. Michelman. It seems that Mr. Michelman accepted the subpoena on behalf of Ms. Ferrer without raising any objections. In July 2025, the Wayfarer Parties issued another subpoena to Ms. Ferrer, asking for documents that were either not provided initially or not specifically requested in Ms. Lively’s initial subpoena. The Wayfarer Parties tried twice to deliver their subpoena to Mr. Michelman, a standard professional courtesy that he may have also extended to Ms. Lively’s legal representative during the first subpoena process.

Ferrer has been in contact with both parties, but Baldoni’s legal team clarified the sequence of events; it was Lively who initially served the Subpoena. According to Baldoni and his team, responding with their own Subpoena is a standard legal procedure.
