Harvey Weinstein’s Rape Retrial Ends in Mistrial After Jury Deadlocks

Harvey Weinstein’s legal journey has once again reached an inconclusive end. 

Harvey Weinstein’s trial for the 2013 rape of Jessica Mann ended in a mistrial on May 15th in New York City. This was his third trial for the case, and the jury was unable to agree on a verdict, according to several news sources.

TopMob News has reached out to Weinstein’s legal team for comment but has not yet heard back. 

In 2017, actress and hairstylist Mann publicly accused Harvey Weinstein of raping her in a New York City hotel. Weinstein’s legal team has since claimed the encounter was consensual, but Mann maintains she fought back and clearly told Weinstein ‘No’ multiple times.

Mann initially shared her account in court during Harvey Weinstein’s 2020 trial, where he maintained his innocence. Ultimately, the jury convicted Weinstein of third-degree rape and a related sexual offense, leading to a 23-year prison sentence.

Four years after his conviction, New York’s highest court reversed the decision, finding that the trial had included inadmissible evidence.

I followed the case closely, and it was incredibly frustrating when they had to retry it in New York during the summer of 2025. The jury just couldn’t agree on the third-degree rape charge that came from Ms. Mann’s accusation. Apparently, things got really tense in the jury room – I read on NBC News that the foreperson told the judge they didn’t even want to go back and try to discuss it further. It was a real standstill.

During the second trial, the jury found Harvey Weinstein guilty of a first-degree criminal sexual act related to the 2006 assault of Miriam Haley, but they did not find him guilty on the same charge concerning the alleged 2006 assault of Kaja Sokola.

Prosecutors stated, according to The Hollywood Reporter, that they intended to retry the case and that Mann was prepared to participate in the new trial, seeking a just outcome.

I’ve been following the Weinstein case closely, and even though his New York retrial wasn’t scheduled to resume until spring of 2026, he wasn’t getting out anytime soon. He was already serving a 16-year sentence – he’d been convicted of rape, forced oral copulation, and sexual misconduct in California back in 2022, and that’s what kept him locked up.

Following the start of the #MeToo movement in 2017, Harvey Weinstein has faced accusations of sexual misconduct from over 80 women. Despite these allegations, he maintains that any encounters were consensual. Weinstein was diagnosed with bone marrow cancer in 2024.

Both the lawyers trying the case and the women accusing Harvey Weinstein have stated that he misused his influence in Hollywood to exploit actresses who were trying to start their careers.

During the June 2025 retrial, prosecutor Nicole Blumberg told the jury, according to The Associated Press, that the victims all aspired to work in the entertainment industry. She stated that the defendant intended to sexually assault them, regardless of their consent.

However, Weinstein’s lawyer reportedly explained the situation as a mutually beneficial exchange, stating, “It was a give-and-take – he was interested in relationships with these women, and they were looking for something in return.”
