
My god, Sony’s legal team is earning its (significant) coin right now, huh?
It feels like a new legal case pops up constantly, and honestly, it’s giving me a headache. Legal documents are just…terrible to read.
This concerns what I’ll call Trump’s Tariffs. A recent case, filed on May 6th, claims a major Japanese company may receive duplicate refunds related to these tariffs.
On August 20th, Sony raised the price of its PlayStation 5 consoles in the US, explaining that current economic conditions and tariffs on imported goods were the reasons for the increase.
But on April 20th of this year, the US Supreme Court decided these actions were illegal. As a result, US Customs and Border Protection (CBP) launched a website to help importers get refunds on tariffs they may have overpaid.
The new lawsuit claims Sony is attempting to unfairly profit twice – first by charging customers higher prices, and then by receiving funds back from the US government.
The argument is that customers who purchased a PS5 console after the price went up because of the tariffs should receive refunds for those tariffs. Essentially, the money should go to the people who actually paid the increased price.
But I think this is going to be difficult to prove.
Sony hasn’t directly blamed tariffs for their price hikes, which gives them flexibility to attribute the increases to general economic difficulties and a range of other issues.
Customers weren’t required to pay the new price for the PS5. Sony is free to set any price for its products, and it’s up to consumers to decide if the price is justified.
Nintendo is also being sued over the same issue, so we can expect similar lawsuits against many large electronics companies. It feels like lawyers are taking advantage of the situation.
It’s too soon to say how much money customers might get back if the case wins, but it would likely be a few dollars after everyone receives their share and legal costs are covered.
