After a year of legal battles, Bungie has reached a settlement with writer Matthew Martineau, who filed a copyright lawsuit against them in October 2024.
So, there’s this lawsuit happening with Destiny 2, and it’s really interesting! It centers around the Red War campaign and this group called the Red Legion. Apparently, a guy named Martineau is claiming that Bungie basically lifted stuff directly from his work he created way back in 2013 and 2014 and used it in the game. It’s wild to think about, if true!
As a longtime fan of both Red Faction and Destiny 2, I’ve always noticed how similar the Cabal in Destiny 2 are to the Red Legion from the Red Faction games, and apparently, author Brian Martineau feels the same way! He’s actually said he believes Bungie borrowed a lot of characters and ideas from his work, which is a pretty bold claim, but when you look at it, it’s hard to dismiss!
Elements like Dominus Ghaul and The Almighty from Destiny 2 were inspired by Yinnerah and the Atonizer weapon, which appeared in the writings of Martinueau.
In December 2024, Bungie asked the court to dismiss the case, arguing that the claims made were without merit and lacked supporting evidence from Martineau.
So, surprisingly, the lawsuit actually didn’t get thrown out! Bungie tried to get the court to dismiss it, but the judge rejected their motion way back in May 2025. It’s still going, which is pretty wild.
As a big Destiny fan, I was shocked to hear about the lawsuit! It turns out the artist, Martineau, didn’t just claim the ‘Red War’ campaign borrowed from his work. He actually expanded the case to include the ‘Curse of Osiris’ expansion too. Apparently, he believes Bungie also took elements of the story, how the characters talk, and even some of the characters themselves from his own creations. It’s pretty serious stuff!
Bungie and Matthew Martineau Agreed to Settle the Destiny 2 Copyright Lawsuit Case
After over a year of legal proceedings, Bungie and Martineau reached a settlement agreement during a conference on November 12, 2025.
The case has been settled, resolving all claims successfully. The court commended the lawyers and parties involved for reaching a friendly agreement.
On November 14th, a court document confirmed that the settlement has been finalized. Judge Susie Morgan stated that everyone involved has reached a compromise.
Therefore, the lawsuit has been dismissed, and no party is responsible for court costs. However, Judge Morgan indicated the case could be reopened if the settlement agreement isn’t finalized within 60 days.
Details about the settlement agreement aren’t available. The court documents don’t state how much money was involved or what other requirements were part of the deal.
This isn’t the only legal issue Bungie is dealing with. They’re also currently involved in a lawsuit filed by former director Christopher Barret, who claims he was wrongfully fired.
According to Barrett, Bungie terminated his employment to avoid paying him roughly $45 million he was owed through their contract.
Some reports indicated that Barrett was wrongly fired because female employees had complained about his inappropriate conduct.
As of now, there are no further details regarding this current lawsuit.
