Rich Kids’ Brendan Fitzpatrick Sued Over Alleged $80 Million Scheme

Brendan Fitzpatrick is in the throes of a legal battle. 

Former reality TV star from Rich Kids of Beverly Hills and his company, Carbonatik, are being sued by Heavy Metal Capital Partners. The lawsuit claims that Carbonatik ran a fraudulent investment operation similar to a Ponzi scheme, causing Heavy Metal Capital Partners to lose approximately $80 million.

Heavy Metal Capital filed a lawsuit in Florida last November, claiming that Fitzpatrick and his company deliberately misled and deceived multiple people to steal their money. TopMob News reviewed the lawsuit on June 17th.

David Smith and Richard Sergeson from Heavy Metal Capital are suing Carbonatik, as well as its representatives J. Joseph Kamalesh Swaminathan and Fitzpatrick. They allege that in January 2025, they were shown a false letter of intent stating Carbonatik had “hundreds of millions of dollars” worth of clean energy projects, which ultimately caused them considerable professional harm.

As a long-time follower, I was shocked to learn that Carbonatik actually asked Heavy Metal Capital for a $500,000 investment just a month later! They promised a huge 120% dividend starting in July 2025, and said it would continue for the next 20 years. Even more concerning, they claimed production was already funded and ready to go, which turned out to be completely untrue. It’s incredibly disappointing to see this kind of behavior.

A trial was originally scheduled for May 24, 2027, but earlier this month, Carbonatik and Fitzpatrick asked the court to dismiss the case brought against them by Heavy Metal Capital. TopMob News has seen the legal document where they requested the dismissal of the entire complaint.

Carbonatik is asking the court to dismiss the claims made by Smith and Sergeson, arguing that they haven’t demonstrated any actual harm.

Carbonatik also points out that Heavy Metal Capital is only mentioning the $500,000 they paid as damages, but isn’t claiming that Smith or Segerson actually lost any money or suffered any real harm themselves.

Heavy Metal Capital requested more time to submit an updated legal complaint on June 4th. Carbonatik countered with a filing on June 15th, arguing that this request should be rejected.

TopMob News has contacted lawyers representing both Carbonatik and Heavy Metal Capital, but they haven’t responded yet.

Even with a recent legal issue, Fitzpatrick has been openly sharing glimpses into his life with his wife, Chloe Fitzpatrick, and their daughter, who was born in 2024. He recently posted a heartfelt Mother’s Day message on Instagram on May 10th, saying, “Happy Mother’s Day to the best mom! We love you!”

Fitzpatrick’s former partner, Morgan Stewart, who famously found love and got married on the show Rich Kids, now has two children with her husband, Jordan McGraw.

Fitzpatrick and Stewart became a couple while filming Rich Kids, but Stewart later revealed that wanting to start a family led her to question whether the relationship would work out.

In a 2020 interview with TopMob News, a year after filing for divorce, Stewart explained that she and her ex-partner weren’t compatible for a long-term future. She said they realized they couldn’t build a life together, including raising children, and ultimately decided they weren’t meant to be partners. She affirmed it was the correct decision.

She told Us Weekly that he surprised her one night by saying he wanted to prove his love and commitment. He even declared he would marry her the very next day, ahead of a small backyard ceremony they’d planned, with a bigger wedding still in the works.

She explained that Thurston’s actions showed his commitment, truly sticking by her ‘in sickness and in health’ and demonstrating he’s a steadfast partner.

Last July, Thurston gave a more positive update, sharing that her tumors had gotten smaller, with her husband supporting her. She told TopMob News in October, “Considering everything, I’m doing well.”
