Kim Zolciak Temporarily Loses Primary Physical Custody of Kids

Kim Zolciak is facing a legal setback.

Kim Zolciak-Biermann, formerly of The Real Housewives of Atlanta, has temporarily lost main custody of her four children with ex-husband Kroy Biermann, according to documents from a recent court filing obtained by TopMob News on May 1.

A judge in Georgia has decided that Kim and Kroy will continue to share legal custody of their children. However, Kroy will make the final decisions regarding their education, non-emergency healthcare, and religious upbringing, according to court documents.

After the court made its ruling, Kim—who started divorce proceedings from Kroy in May 2023 following 11 years of marriage—shared her response.

She told TopMob News on May 1st that her biggest wish is for this difficult situation to be over for her children, but she’s also eager to have her day in court and share what really happened.

TopMob News has reached out to a rep for Kroy for comment but has not heard back.

Last month, Kroy requested full custody of his and Kim’s four children—14-year-old K.J., 13-year-old Kash, and 12-year-old twins Kaia and Kane—claiming Kim is an unstable and unfit parent. According to court documents obtained by TMZ, he alleges she prioritizes her career and public image over the well-being of the children and the advice of professionals.

Kim’s lawyer responded to the claims, telling TMZ that Kroy’s legal move is unsupported by facts and unnecessary. They plan to defend Kim’s side of the story fully in court, not through media statements.

In March, Kroy also asked the court for full custody of their four children. According to legal documents obtained by Us Weekly, he stated that the reality star hadn’t been fulfilling basic parenting duties in a way that would be hard to believe for those unaware of the situation.

Kim, however, strongly disagreed with his claims.

She strongly denied the claims, calling them a calculated effort by Kroy to damage her reputation. She stated she wouldn’t be intimidated or allow false stories to define her, and she was determined to reveal the truth, no matter how much someone tried to hide it.

The judge approved a temporary plan where the children will continue living with Kroy while Kim attends four therapy sessions. After she completes them, they’ll go back to following their original court-ordered parenting plan, unless the court decides to change it, according to documents obtained by Us Weekly on April 3.

After 11 years of marriage, Kim Zolciak filed for divorce from Kroy Biermann on May 8, 2023, and no longer saw any significance in her wedding ring.

TMZ reports that the couple officially separated on April 30, 2023. The former Real Housewives of Atlanta star stated their marriage is beyond repair and cannot be saved.

Kim and her ex, former NFL player Kroy Biermann, share six children: Kroy Jr., Kash, twins Kane and Kaia, and daughters Brielle and Ariana. Kim has filed for primary physical custody and joint legal custody of all the children, according to court documents.

The day after Kim filed for divorce, Kroy also requested to have full custody of their four children.

According to legal papers obtained by TopMob News, Kim and Kroy Biermann have been asked to participate in a 30-day program where professionals will monitor how they are parenting their children. They received a summons requiring them to complete an intake worksheet as part of this process.

When Kroy announced their divorce, he asked the court to grant him sole use of their Georgia home, and any other property they acquired during their marriage, both temporarily and permanently.

According to court documents obtained by TopMob News, Kim claims she has witnessed Kroy smoking marijuana and is worried about the impact on their children’s safety and well-being. She requested a five-panel hair follicle drug test to help the court decide on custody arrangements and specifically asked that Kroy not cut his hair before the test.

 

The same day Kim submitted her request, she posted a puzzling message about relationships on social media.

She shared a quote to her Instagram Stories that said, “True love is about consideration – really thinking about how your actions will affect someone, paying attention to the little things, and keeping their feelings in mind when making decisions.” She emphasized this point by adding a 100 emoji, suggesting she strongly believes that how much someone cares is shown by how much they consider your feelings.

Kim took to Instagram to share another arcane message about relationships on May 24, 2023. 

Kim Kardashian shared a quote on her Instagram story that said, “Manipulation is when they blame you for how you react to their harmful actions, instead of taking responsibility for the disrespect that caused your reaction.” She then emphasized the message by writing, “Read that again…” in capital letters.

The breakup shocked not only fans, but also Andy Cohen, who used to work with Kim and Kroy.

I was really shocked,” Andy Cohen confessed on his SiriusXM radio show, Andy Cohen Live, on May 9, 2023. “It was the last thing I expected to hear. They always seemed so happy and committed to each other. Honestly, I thought their relationship would last forever.”

While Kim and Kroy were going through their divorce, her oldest daughters, Brielle and Ariana (who Kroy adopted after they got married), shared birthday wishes for Kim’s 53rd birthday.

Ariana shared a sweet message to her mom on Instagram on May 19th, posting a beachside photo with the caption: ‘You’re the strongest woman I know! Thank you for everything, and I’m so proud of you! Happy 53rd!’

Brielle posted a picture with her mom on Instagram Stories, celebrating her birthday and sharing a sweet message: “Happy birthday, Mom! I love you so much!”

Shortly after filing for divorce, Kim changed her name on Instagram, officially removing her married surname.

Kim hinted at her comeback to RHOA by changing her social media handle. She shared a photo with original cast members Lisa Wu, DeShawn Snow, and Sherée Whitfield, and simply wrote, “See you soon,” on June 8th.

Only two months after revealing they were separating, Kim and Kroy have decided to try and work things out and stay married.

According to court documents obtained by TopMob News, the former Real Housewives of Atlanta star filed paperwork on July 7, 2023, to end their divorce proceedings. The former NFL player’s lawyer, Marlys A. Bergstrom, confirmed to TopMob News that they are dropping the divorce and trying to work things out.

I’ve been following the story, and it’s interesting to note that just days before all this unfolded, Kim and Kroy were seen walking to church with their four youngest children. It really paints a picture, doesn’t it? It’s a reminder that even when things seem complicated publicly, there’s always a personal side to every story.

Unfortunately, the couple’s attempt to get back together didn’t work out. Kroy filed for divorce again on August 24, 2023, according to TMZ. He claims their marriage is beyond repair and is requesting full legal and physical custody of their four children. He is also asking for child support and spousal support (alimony).

On September 25, 2023, Kim filed a request to have Kroy’s divorce case dismissed. She claims that despite their separation, she and her husband of 11 years are still intimate.

According to legal documents obtained by TopMob News, the Bravo star claims that despite a divorce filing, the couple has continued to have sexual relations, most recently around September 7, 2023. This contradicts claims made in the divorce petition.

Even though Kim and Kroy are in the process of getting divorced, they came together to celebrate 12 years of marriage on November 11, 2023, with a private Italian dinner.

Kroy filed for divorce again in February 2025, stating in court documents that his marriage to the singer, known for “Tardy to the Party,” was beyond repair.

Court documents obtained by TopMob News show that in April 2026, Kim temporarily no longer had primary physical custody of her and Kroy’s four children. While they will continue to share legal custody, the judge decided Kroy will make the ultimate decisions regarding their kids’ education, regular medical care, and religious upbringing.

 

Kim expressed her feelings about the decision in a statement to TopMob News, saying she primarily wants the situation resolved for her children. She also stated she’s eager to have a full court hearing where she can share her side of the story.

 

Earlier this year, Kroy requested full custody of their children, arguing in court documents from April 2026 that Kim was an unstable and unfit parent. He claimed she prioritized her career and public image over the children’s well-being and expert advice.
